When you register a trade mark it protects your brand and differentiates your goods from other businesses. The ‘mark’ can take the form of words, slogans, colours, designs, letters, numerals, sounds, smells and gestures. For example, the name of your product or services and logos.

The registered trade mark gives you exclusive right to use the trade mark in Scotland and the rest of the UK. It also allows you to take legal action against anyone who uses your trade mark without your permission, including counterfeiters.

How to apply

You can apply to register your trade mark at the UK Intellectual Property Office (UKIPO) and it normally takes four-six months on average if there are no objections to the registration.

To register a mark can cost between £170– £200 with an additional £50 for each class you would like your mark to cover. Registration lasts for ten years but you can renew the mark indefinitely.
